1. Application
These Terms of Use govern the use of DirectCue (the “App”), provided by TOMOSHIBI LLC (“we,” “us,” or “our”). By using the App, you agree to these Terms.
2. The App
DirectCue is a macOS menu bar app that lets users place change instructions on a selected Mac screen target and locally create an annotated image, AI-ready Prompt, human-readable Markdown, and structured manifest.
The App primarily provides:
- Area, currently visible Window, or current Screen capture, with an optional three-second Freeze
- Fix, Line, Draw, Remove, Swap, Move, and General context annotations
- Local creation of `raw.png`, `annotated.png`, `prompt.md`, `instructions.md`, and `annotations.json`
- User-initiated copy or drag of Image, Prompt, Markdown, or Bundle output
- Viewing, copying, and deleting output saved to History with `Save & Close`
The App does not modify the screen, make AI decisions or rewrites, send content to an AI service automatically, provide team sharing or cloud sync, or include dedicated third-party service integrations.
Output files are saved in a folder the user chooses with the standard macOS folder chooser. The location can be changed in Settings > Output. See the Privacy Policy for screen-data use, storage, sharing, retention, and deletion.
3. Requirements and screen capture
The App requires a Mac running macOS 26 or later and macOS Screen Recording permission. App Store purchases or restores may also require an Apple Account, network access, and other conditions set by Apple.
Window capture targets a currently visible window that the user can bring to the front. The App does not guarantee complete capture of hidden content, covered portions, protected content, or screens restricted by another app or the system.
4. Free and DirectCue Pro
4.1 Free
Free includes all six tools: Fix, Line, Draw, Remove, Swap, and Move. A user may create up to three Prompts per local calendar day. Usage is consumed only after `DONE` succeeds and creates an output package containing the Prompt. Saved History remains available for viewing and copying after the daily limit, and the allowance returns on the next local calendar day.
Free and DirectCue Pro both provide History retention choices of 20, 50, or Unlimited. The default is 20.
4.2 DirectCue Pro
When a DirectCue Pro entitlement is active, only the daily Prompt-creation limit is removed. DirectCue Pro is not a subscription.
If offered through the App Store, DirectCue Pro is provided as a non-consumable in-app purchase at the price shown at the time of purchase. Billing, refunds, purchase approval, restore, and related purchase processes are handled through Apple and are also subject to Apple's terms.
5. User responsibilities
You are responsible for:
- Providing and appropriately managing the device, OS, permissions, Apple Account, and network access required to use the App
- Obtaining the rights, permission, and consent required to capture, annotate, save, copy, drag, or share content
- Avoiding infringement of copyright, trademark, publicity, privacy, confidentiality, or other third-party rights
- Reviewing generated images, Prompts, Markdown, and manifests before using or sharing them
- Managing and, when necessary, backing up or deleting local output and History
- Reviewing the terms and information practices of any AI service, chat, file-sharing destination, or other third party to which you send content from the App
6. Prohibited conduct
You must not:
- Violate laws or public order
- Infringe third-party rights or interests
- Capture, store, distribute, or share a screen or content without the required rights, permission, or consent
- Access, analyze, interfere with, modify, or reverse engineer the App or related systems unlawfully
- Circumvent Free limits, DirectCue Pro entitlement state, or other usage controls unlawfully
- Use the App for harmful software, illegal content, or the purpose of harming another person
- Interfere with operation, support, or another user's use of the App
- Engage in other conduct that we reasonably determine to be inappropriate
7. Intellectual property and user content
Rights in the software, screens, design, logos, copy, templates, and other materials included in the App belong to us or the applicable rights holder.
Rights in images, annotations, instructions, and other content that a user captures or enters remain with the user or applicable rights holder. Using the App alone does not transfer ownership of that content to us.
Third-party rights and conditions continue to apply to third-party content included in generated output.
8. Third-party services and information handling
The App may use Apple's ScreenCaptureKit, App Store, and StoreKit, as well as Firebase Analytics and Sentry when the user separately enables the corresponding optional setting. Third-party terms and privacy policies may apply.
Usage Analytics and Crash Diagnostics are off by default and send data only for a setting the user enables. Captures, annotations, Prompts, Markdown, clipboard contents, and output files are excluded from these optional transmissions. DirectCue removes device-specific local file paths before a Crash Diagnostics event is sent.
The App does not automatically send captures, annotations, Prompts, Markdown, or manifests to an AI service. Information the user explicitly sends or shares outside the App is handled under the recipient's terms and privacy policy.
9. Changes, suspension, and termination
We may change, suspend, or discontinue all or part of the App, the Free tier, DirectCue Pro, or the method of providing them when necessary.
Availability may be limited because of maintenance, incidents, OS or permission changes, App Store or third-party restrictions, legal requirements, or other unavoidable circumstances.
10. Disclaimer
We do not guarantee that:
- The App will be continuously available or free of errors
- Every Mac, OS version, display setup, app, window, permission state, or environment will behave identically
- Captures, annotations, Prompts, Markdown, or manifests will be accurate, complete, or fit for a particular purpose
- An AI or other recipient will implement the intended change or achieve a particular result
- Local output or History will never be lost, damaged, or changed
The App assists in creating a handoff that connects screen locations to instructions. It does not guarantee screen changes, AI responses, third-party work, or business outcomes.
Except where liability cannot be limited under applicable law or where loss results from our intentional misconduct or gross negligence, we are not responsible for damages arising from use of or inability to use the App.
You are responsible for disputes or losses arising from content you capture, enter, store, copy, drag, send, or share.
11. Changes to these Terms
We may revise these Terms when necessary. Material changes will be announced on the published page or in the App.
12. Governing law and jurisdiction
These Terms are governed by Japanese law. The court with jurisdiction over our principal place of business will have exclusive jurisdiction as the court of first instance for disputes between you and us relating to the App.
